Terms of Service

Wachee is operated by Hexadelic. We offer a digital service for creating and hosting personalized pages: you build the experience in our editor, pay for the chosen plan and receive a link and a QR Code to share with whoever you want.

The service is delivered entirely digitally. No physical product is shipped unless expressly stated in the offer.

By creating an account, placing an order or using any feature, you confirm that you have read and accept these Terms and our Privacy Policy.

The service is intended for people aged 18 or over. Minors may only use Wachee with the consent and supervision of a parent or legal guardian, who takes responsibility for the use and for the content submitted.

If you do not agree with these Terms, do not use the service.

Some features require registration. You are responsible for keeping your credentials confidential and for all activity carried out through your account.

Tell us immediately if you notice unauthorized use. We may require e-mail verification before releasing certain features.

Prices, plans and included items are those displayed at the time of purchase. Optional extras are charged separately where applicable.

Payment is processed by a partner institution. We do not store full card data in our systems.

Delivery happens when your page is published and the link and QR Code are made available, normally right after payment confirmation.

Until payment is confirmed, the experience stays as a draft and is not published.

Under article 49 of the Brazilian Consumer Protection Code, for purchases made outside a physical store you may withdraw within 7 (seven) calendar days from the purchase or from receiving access, whichever is later.

To exercise this right, write to [email protected]. If you withdraw within the period, the amount paid is fully refunded and the page is unpublished.

Outside that period, refunds are assessed case by case, particularly where a failure in the service is demonstrated.

All content you upload — photos, text, dates, names, music choices — remains yours. We claim no ownership over it.

You grant us a free, non-exclusive and limited license to store, process, technically adapt (resize, compress, convert format) and display that content, for the sole purpose of operating and delivering the experience you purchased.

This license lasts while the page exists and ends when the content is deleted, except for backup copies kept for the technically necessary period.

We do not use your content in marketing materials without your express and specific authorization.

A Wachee experience is almost always about someone else. By uploading third-party photos, names, dates or messages, you confirm you hold the necessary rights and permissions, including image rights.

For that content you act as the data controller and Hexadelic acts as data processor, handling it only under your instructions and as needed to provide the service (LGPD, article 5, VI and VII).

If the person portrayed asks us directly for removal, we may honor the request and inform you, even while the page is live.

It is forbidden to publish illegal, offensive, discriminatory, violent or sexually explicit content, content that exposes children or adolescents inappropriately, or content that infringes third-party rights — copyright, image, honor or privacy.

It is forbidden to use the service for fraud, harassment, spam, phishing, malware distribution or any practice that compromises the security of the platform or of third parties.

It is forbidden to attempt to access restricted areas, bypass plan limits, reverse engineer the service or automate access abusively.

We work to keep the service available, but we do not guarantee uninterrupted or error-free operation. Downtime may occur for maintenance, updates or causes beyond our control.

We may evolve, change or discontinue features. Relevant changes affecting already published experiences will be announced with reasonable notice.

Support is provided through the official channels listed on the site.

The Wachee brand, the software, the templates, layouts, animations, institutional copy and other platform elements belong to Hexadelic and are protected by law.

Purchasing a plan grants the right to use the experience you created, not ownership of the technology or templates behind it.

Personal data processing is described in the Privacy Policy, which is part of these Terms and follows the Brazilian General Data Protection Law (Law 13,709/2018).

We act as controller for your account and order data, and as processor for the personal data contained in the content you assemble.

Wachee is provided for personal and affective use. We are not responsible for content uploaded by users nor for how third parties use the link you share.

We are not liable for indirect damages, lost profits or data loss arising from force majeure, the user's connection failures or use in breach of these Terms.

Nothing in these Terms removes the legal warranties set out in the Consumer Protection Code.

We may suspend or terminate access, with prior notice whenever possible, in case of breach of these Terms, legal determination or risk to platform security.

You may close your account and request deletion of your content at any time through our contact channels.

We may update these Terms to reflect changes in the service or in the law. The update date at the top of this page indicates the version in force.

Significant changes will be announced by e-mail or by notice on the site. Using the service after they take effect means you accept the new text.

These Terms are governed by the laws of the Federative Republic of Brazil.

The courts of the consumer's domicile are elected to settle disputes, as provided by the Consumer Protection Code.
